By accessing or using OPTIMAGE ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.
2. Description of Service
OPTIMAGE provides an image optimization and hosting service that converts images to WebP format, generates multiple responsive sizes, and delivers them via a global CDN. The Service includes a web interface and API for uploading and managing images.
3. Account Registration
To use certain features of the Service, you must:
- Create an account with a valid email address
- Provide accurate and complete information
- Maintain the security of your account credentials
- Be at least 13 years of age
- Accept responsibility for all activities under your account
4. Acceptable Use
You agree NOT to use the Service to:
- Upload, store, or distribute illegal content
- Upload content that infringes on intellectual property rights
- Upload malicious files, viruses, or harmful code
- Upload pornographic, obscene, or offensive content
- Attempt to circumvent usage limits or security measures
- Use the Service for spam or unauthorized advertising
- Resell or redistribute the Service without authorization
5. Content Ownership
You retain all ownership rights to the images you upload. By uploading content, you grant OPTIMAGE a limited license to process, optimize, store, and deliver your images as necessary to provide the Service. This license terminates when you delete your content or account.
6. Usage Limits and Quotas
Free accounts are subject to monthly upload limits as specified in your account dashboard. Quotas reset on the first day of each calendar month. Exceeding your quota may result in temporary suspension of upload capabilities. Deleting images does not restore quota usage for the current billing period.
7. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any downtime, data loss, or service interruptions.
8. Termination
We may suspend or terminate your account at any time if:
- You violate these Terms
- Your use poses a security risk
- Required by law
- You engage in abusive behavior
You may terminate your account at any time by contacting us. Upon termination, all your data will be deleted and image URLs will stop working.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPTIMAGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
11. Indemnification
You agree to indemnify and hold harmless OPTIMAGE and its affiliates from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which OPTIMAGE operates, without regard to conflict of law principles.
